From copilot: Charles Swayne was a United States district judge of the United States District Court for the Northern District of Florida. In 1904, he faced impeachment but remained on the bench after the impeachment trial ended in an acquittal. Here are the details:Education and Career: Born in Guyencourt, Delaware, Swayne received a Bachelor of Laws from the University of Pennsylvania Law School in 1871. He practiced law in Philadelphia, Pennsylvania, from 1871 to 1885, and later in Pensacola, Florida, from 1885 to 1889. In 1888, he ran as an unsuccessful Republican candidate for the Florida Supreme Court1.Federal Judicial Service: Swayne received a recess appointment from President Benjamin Harrison on May 17, 1889, to a seat on the United States District Court for the Northern District of Florida, which had been vacated by Judge Thomas Settle. He was later nominated to the same position by President Harrison on December 5, 1889. Swayne was confirmed by the United States Senate on April 1, 1890, and served until his death on July 5, 19071.Impeachment and Acquittal: Swayne faced impeachment by the United States House of Representatives on December 13, 1904. The charges against him included filing false travel vouchers, improper use of private railroad cars, unlawfully imprisoning two attorneys for contempt, and living outside of his district. His impeachment trial lasted months and concluded on February 27, 1905, when the Senate voted for acquittal on each of the twelve articles. Although there was little doubt that Swayne was guilty of some of the offenses, the Senate did not find them to be “high crimes and misdemeanors” warranting conviction12.So, despite the evidence against him, Charles Swayne was acquitted and continued to serve as a federal judge. His case also led to discussions about the impeachment process and the role of Senate committees in handling evidence during trials1.Excellent original early family and/or town genealogy, history, antique, collectible heirloom and/or ephemera. autographCONDITION: MISSING TITLE PAGE.
