Book 16 page 55 Rough Partial Transcript STATE OF VERMONT, Chittenden County, SS: TO any SHERIFF or CONSTABLE in the State, GREETING: BY THE AUTHORITY OF THE STATE OF VERMONT, You are hereby commanded to attach the goods, chattels, or estate of Abel N. Austin and Aldace M. Austin of Milton in the county of Chittenden to the value of 150 dollars, and then notify thereof according to law; and also notify them to appear before the County Court, next to be held at Burlington within and for the county of Chittenden on the 4th Tuesday of September A.D. 1861, then and there in said court to answer unto Merrick Flynn of Milton in a plea that the defendant is indebted to the plaintiff in the sum of 124 dollars and 38 cents. The cause of this action being the non-payment of a promissory note duly executed by the defendants and payable to the plaintiff or bearer on demand, dated April 10, 1860, for the sum of 109 dollars and 8 cents with interest. The plaintiff claims damages of 150 dollars for the recovery thereof. And you are further commanded to summon Hiram S. Saxe of Burlington in said County, trustee of the said defendants, to appear before said court, at the time and place aforesaid, and make disclosure, according to law, of the goods, chattels, rights, or credits of the said defendants, or either of them, which the said Saxe may have in his hands or possession. Fail not, but make service and return according to law. Dated at Burlington in the County of Chittenden this 11th day of September in the year one thousand eight hundred and sixty-one. Israel P. The writ is issued in response to a debt claim by Merrick Flynn. tate of Vermont Chittenden County SS At Burlington September 4th, 1861 I then served this writ on the within named Prouty by delivering to him a true and attested copy of the same with this my return thereon endorsed, and on the 6th day of September 1861, I served this writ on the within named Sidney Prouty by leaving for him at his usual place of abode a like true and attested copy of the same with this my return thereon endorsed, to the hands of Mrs. Cutter, resident therein and a person of sufficient discretion to receive the same.
